Terms of Use, Privacy & Policies

By accessing or using the HighRise Safety website, registering for any course, or attending training at any HighRise Safety location, you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Use, Privacy & Policies (“Terms”). Use of this website constitutes acceptance of these Terms.
IF YOU DO NOT AGREE TO THESE TERMS IN FULL, YOU MUST NOT USE THIS WEBSITE OR REGISTER FOR ANY COURSE.
1. Scope of Terms
These Terms govern all use of HighRise Safety’s website, training services, instructional materials, facilities, and related communications. These Terms apply to all students, visitors, and users without limitation. Use of this website constitutes acceptance of these Terms.
HighRise Safety reserves the right to update or modify these Terms at any time. Continued use of the website or services constitutes acceptance of the revised Terms.
2. Training Compliance & Student Conduct
HighRise Safety provides safety training programs compliant with applicable New York City Department of Buildings (DOB) requirements and authorized by OSHA where applicable.
Students must follow all instructor directions, maintain professional conduct, comply with facility rules, and present valid government-issued photo identification upon request. Failure to comply may result in removal from class without refund.
3. Attendance & Completion Requirements
To earn course credit, certificates, OSHA cards, or SST cards, students must strictly comply with all attendance requirements, including:

Attendance of 100% of required training hours (DOB mandate)

Timely arrival (late arrival exceeding 15 minutes may result in denial of entry)

Attendance for the entire class duration

Completion of all required course components

Presentation of valid government-issued photo ID
Training hours cannot be waived, shortened, transferred, or reduced under any circumstances.
4. Missed Classes & Make-Up Policy
HighRise Safety strictly follows OSHA and NYC DOB regulations. Partial attendance does not count toward course completion.
If a student misses any portion of a class for any reason—including transportation delays, weather, work schedule conflicts, personal matters, or public events—the missed time will not be credited.
No certificate, OSHA card, or SST card will be issued until all required hours and course components are fully completed.
Attendance is the sole responsibility of the student. HighRise Safety is not responsible for personal conflicts, emergencies, or logistical issues. Tuition for missed classes is non-refundable.
Make-up classes are not guaranteed. At HighRise Safety’s sole discretion, a make-up option may be offered if space, instructor availability, and administrative capacity permit. Documentation may be required, and additional fees may apply.
If no make-up option is approved, the student must re-enroll and repurchase the course. Approved make-up hours must be completed within six (6) months of the original course start date. After this period, the student may be required to restart the course in full.
5. Cancellation, Rescheduling & No-Show Policy
All course sales are final. No refunds are issued under any circumstances.
Requests to reschedule must be submitted at least five (5) business days prior to the scheduled class date. Approved rescheduling is subject to availability and current pricing.
Failure to attend without proper notice constitutes a no-show and may result in forfeiture of tuition and rescheduling privileges.
HighRise Safety reserves the right, at its sole discretion, to cancel or reschedule any class with fewer than ten (10) registered students. In such cases, students will be offered a rescheduled date or course credit. No refunds will be issued.
6. Urgent Need for Certification
An urgent need for a card or certification (including employment start dates) does not permit modification, waiver, or reduction of required training hours. Seat availability and processing timelines are not guaranteed.
7. Right to Refuse Service
HighRise Safety reserves the right to refuse service or remove any student whose behavior is disruptive, unsafe, or non-compliant with instructor directions, facility rules, or these Terms, without refund.
8. Prohibited Website Use
Users agree not to post false or unlawful content, circumvent payment or security systems, use automated tools or bots, upload malware, or collect personal data of others without consent.
HighRise Safety may restrict or terminate access for violations without notice.
9. Course Information & Changes
HighRise Safety reserves the right to modify course offerings, schedules, pricing, instructors, and descriptions at any time. While reasonable efforts are made to ensure accuracy, errors may occur. If a material error affects registration, HighRise Safety will determine an appropriate resolution at its discretion.
10. Privacy Policy
HighRise Safety collects personal information including contact details, enrollment and completion records, payment information, and technical data such as IP address, browser, and device information.
Information is used solely for operational, regulatory, and communication purposes. Personal data is not sold or rented to third parties.
11. Limitation of Liability
To the maximum extent permitted by law, HighRise Safety shall not be liable for indirect, incidental, or consequential damages. Total liability, if any, shall not exceed the amount paid for the specific course giving rise to the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless HighRise Safety, its owners, employees, agents, and affiliates from any claims, damages, liabilities, or expenses arising from your violation of these Terms or misuse of services.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of New York. Any dispute shall be resolved exclusively through binding arbitration in New York, NY, under the rules of the American Arbitration Association (AAA). You waive the right to a jury trial and participation in class actions.
14. Severability
If any provision of these Terms is found invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
15. Entire Agreement
These Terms constitute the entire agreement between you and HighRise Safety and supersede all prior or contemporaneous communications, representations, advertisements, or agreements, whether oral or written.
16. No Waiver
Failure by HighRise Safety to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
17. Force Majeure
HighRise Safety shall not be liable for delays, cancellations, or failures to perform caused by events beyond its reasonable control, including weather conditions, natural disasters, government actions, power outages, labor disputes, or public emergencies.
18. Referral Discount
The $25 referral discount applies only to full-price courses and may not be combined with other promotions or discounted offerings. One referral discount per student per course applies unless otherwise stated. HighRise Safety reserves the right to modify or discontinue this program at any time.
19. SMS & Email Communications
By opting in, you consent to receive SMS and email communications including class reminders, certification notifications, updates, and promotions.

20. Pricing Policy
Prices, fees, and promotions are subject to change without notice. Final pricing is confirmed only upon successful payment. Prior pricing or advertisements do not guarantee future rates.
